A few days after the Delhi High Court left it to regulators Securities and Exchange Board of India (SEBI) and Competition Commission of India (CCI) to decide the legality of the 24,713 crore Future Retail-Reliance Group deal, Future Retail has written a letter to National Stock Exchange (NSE) and Bombay Stock Exchange (BSE). The letter has pointed out portions of the court order where the August 29 board resolution of the company to proceed with a deal of the company's retail assets with Reliance Group was upheld. Future Retail has sought that regulators should base their decision on the Delhi High Court order, and not the Emergency arbitrator's order whose merits haven't yet been examined by Indian courts.Future Retail had welcomed the court order which made a prima facie case of tortious interference by Amazon and held that Amazon's attempt to control Future Retail without the government's approval violated FEMA and FDI rules. However, the Delhi High Court also paved the way for Amazon to write letters to SEBI and CCI to oppose the deal, in view of the potential of "irreparable damage to business".
